Terms of Use Policy
Definitions
"HybridIRC" or "HybridIRC Server" refers to any server or servers operating under the HYBRIDIRC.COM domain name, providing services and functionalities associated with the HybridIRC network.
"The Administrators" refers to individuals authorized by the owner of a HybridIRC server to act as IRC operators, including the owners themselves, who oversee the management and operation of the network.
Terms and Conditions of Use
Please read these Terms of Use carefully. These terms include and incorporate the Privacy Policy and the Acceptable Use Policy (collectively referred to as "the Terms").
HybridIRC is a private IRC network; access is granted only to users who understand and agree to follow this Acceptable Use Policy (AUP). If you do not agree to these terms, please disconnect from all HybridIRC servers immediately and cease all attempts to access or use any HybridIRC services.
Your access to HybridIRC may be revoked at any time, either temporarily or permanently, for any reason, and without prior notice or explanation.
The administrators are not responsible for the actions of IRC users. IRC is an unmoderated environment, and you connect at your own risk.
THE ADMINISTRATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE), ARISING IN ANY WAY OUT OF THE USE, ATTEMPT TO USE, OR INABILITY TO USE THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Under United States Code (U.S.C.), Title 18, Part 1, Section 2701 (c), HybridIRC may scan your system to ensure it does not pose a security risk to our network or its users. By connecting to any HybridIRC server, you consent to such scans, which will be performed at the discretion of the administrators.
Attacks or viruses that disrupt, damage, or otherwise harm this network or its users are illegal under Title 18, U.S.C. Part 1, Chapter 47, Section 1030, and the Canadian Criminal Code s. 342.2.
Accessing HybridIRC after being specifically denied access is illegal. Violators may have their ISP or law enforcement notified. Any suspected violation of this AUP or criminal activities may result in monitoring and disciplinary actions by the administrators, your ISP, and/or law enforcement. The administrators will fully cooperate with any ISP, law enforcement agency, or court order to help apprehend suspects.
If any provision of this AUP is found to be invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the AUP. The invalid provision will be reformed to the minimum extent necessary to make it valid and enforceable.
